These Terms of Service (“Terms”) govern your use of https://birthday.bigdaycard.com/ and our Service. By using them, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use the Service. The Service is designed for parents and legal guardians creating birthday designs for their children; it is not directed at, and may not be used by, minors. By uploading a photo, you represent and warrant that you are the parent or legal guardian of the child shown (or have that person’s explicit authorization) and that your use of the Service complies with all applicable laws.
2. Account and Usage
- No account required, but Email, IP and Device ID are tracked for limits.
- Uploads must not infringe rights or contain illegal content.
- We may terminate access for violations.
3. Acceptable Content
When using the Service, you must not:
- Upload photos of any child other than your own (or one whose parent/legal guardian has expressly authorized you);
- Upload photos or text that are sexual, violent, hateful, or otherwise inappropriate for a children’s service;
- Request designs featuring copyrighted or trademarked characters, brands, logos, or franchises. Our system automatically reinterprets such requests as original artwork, and we may reject submissions entirely;
- Attempt to bypass, manipulate, or probe our automated content screening;
- Use generated designs in any unlawful way, or resell them as stock or template assets.
We may refuse generation, remove content, or terminate access for violations. Submissions rejected by our content screening do not consume free generations and are not processed further.
4. Intellectual Property
- Your Content: You retain rights to uploads but grant us a license to process.
- Our Content: Invitations are AI-generated; you get non-exclusive use after payment.
- AI-Generated Results: Designs are created by artificial intelligence and are unique, non-deterministic artworks. While our system is designed to produce original art and to avoid third-party intellectual property, you are responsible for your own use of the generated design. If you believe a generated design infringes your rights, see “Intellectual Property Complaints” below.
- Results May Vary: AI generation is creative by nature. Likeness, style, and text rendering can vary between generations; free previews and the regenerate option exist so you can review your design before purchasing. A design you have previewed (in watermarked form) is the design you receive.
- Prohibited: Reverse engineering, copying our Site.
5. Payments
- Via our supported payment processors. Refunds per our policy (e.g., no refunds after download).
- Refund policy (all customers, worldwide): once a design has been successfully downloaded, the purchase is final and non-refundable, except where a mandatory consumer law in your jurisdiction provides otherwise. Customers have 24 hours from the time of purchase to report any issues with downloads or image generations. After this period, all related information and files will be automatically deleted as per our data cleanup policy (see Section 6). No refunds will be issued upon successful download or after the 24-hour reporting window has expired.
- EU/EEA Right of Withdrawal: By purchasing and downloading a design, you expressly consent to immediate delivery of digital content and acknowledge that you thereby lose your 14-day right of withdrawal under EU Consumer Rights Directive 2011/83/EU once the download begins. This does not affect your right to report defective deliveries within the 24-hour window above.

6. Limitations
- Free: Up to 5 generations (watermarked previews).
- Paid: Full access without watermarks.
- Data Cleanup: Files deleted after 24 hours.
7. Disclaimers
- Service “as is.” No warranties.
- Not liable for indirect damages.
8. Governing Law
EU law. Cyprus courts for disputes.
9. Changes
We may update Terms. Continued use = acceptance.
10. Intellectual Property Complaints
We respect intellectual property rights and design our systems to produce original artwork. If you believe any content generated or displayed through the Service infringes your copyright or trademark, email privacy@bigdaycard.com with: (a) identification of the protected work, (b) the URL or description of the allegedly infringing content, (c) your contact details, and (d) a statement that you believe in good faith the use is unauthorized. We review all complaints promptly and remove infringing content. Note that all generated files are automatically deleted 24 hours after creation in the normal course of operation.
